These Terms of Service ("Terms") govern your use of the Floor40 desktop application and related services provided by Wurk Pty Ltd (ABN 18 606 911 371), trading as Floor40 ("we", "us", "our").
By downloading, installing, or using Floor40, you agree to be bound by these Terms. If you do not agree, do not use Floor40.
Floor40 is a desktop application that provides AI-powered business intelligence and analytics for small and medium businesses. The application runs locally on your device and connects to third-party accounting software (QuickBooks, Xero) to provide business insights.
Floor40 is currently available to businesses in Australia and New Zealand. You must be at least 18 years of age and have the legal authority to bind your business to enter into these Terms.
You must create an account to use Floor40. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
Floor40 offers subscription plans as described on our Pricing page. All prices are in US Dollars (USD).
New subscribers receive a 7-day free trial. A valid credit card is required to start the trial. If you do not cancel before the trial ends, your subscription will automatically begin and your card will be charged.
Subscriptions are billed monthly or annually in advance. Payments are processed securely through Stripe.
You may cancel your subscription at any time from within the app. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial billing periods, except as required by Australian Consumer Law.

Floor40, including its code, design, knowledge packs, and documentation, is the intellectual property of Wurk Pty Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use Floor40 as described in the End User Licence Agreement.
You own all business data that you import into or create within Floor40. Your data is stored locally on your device and is not accessible to us. We make no claim to ownership of your business data.
Floor40 integrates with third-party services including QuickBooks, Xero, Stripe, OpenAI, and Anthropic. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or security of third-party services.
Floor40 is provided "as is" and "as available". While we strive to provide accurate business insights, Floor40 is not a substitute for professional financial, legal, or tax advice. You should consult qualified professionals for important business decisions.
To the maximum extent permitted by Australian Consumer Law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Wurk Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Floor40. Our total liability shall not exceed the amount you paid for Floor40 in the 12 months preceding the claim.
Nothing in these Terms excludes or limits any consumer guarantee under the Australian Consumer Law that cannot be excluded or limited.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of Floor40 after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.
